Article 1 Scope of application

1. Accommodation contracts and related contracts concluded by ALA HOTEL KYOTO (hereinafter referred to as "the hotel") with guests shall be governed by these terms and conditions, and matters not stipulated in these terms and conditions shall be governed by these terms and conditions. , By law or generally established customs.

2. If the Hotel accepts a special contract to the extent that it does not violate laws and customs, that special contract shall prevail regardless of the provisions of the preceding paragraph.

Article 2 Application for accommodation contract

1. Those who wish to apply for an accommodation contract with the hotel are requested to inform the hotel of the following matters.
(1) Guest name and phone number
(2) Accommodation date and estimated time of arrival
(3) Accommodation charges (in principle, based on the basic accommodation charges in the attached table)
(4) Other matters deemed necessary by the hotel

2. If the guest requests to continue staying beyond the staying date set forth in item 2 of the preceding paragraph during the stay, the hotel will treat it as if a new accommodation contract had been applied at the time the request was made. To do.

Article 3 Establishment of accommodation contract, etc.

1. The accommodation contract shall be concluded when the hotel accepts the application set forth in the preceding article, and the hotel accommodation contract shall be applied as the contract content when staying. In addition to the hotel accommodation agreement, the terms and conditions of each reservation site will also apply to accommodation applications via the Internet. However, this does not apply when the hotel proves that it has not consented.

2. When the accommodation contract is concluded pursuant to the provisions of the preceding paragraph, the application fee set by the hotel up to the basic accommodation fee for the accommodation period (3 days if it exceeds 3 days) shall be applied by the date designated by the hotel. Please pay.

3. The application fee will first be applied to the accommodation fee to be finally paid by the guest, and if the provisions of Articles 6 and 18 apply, the penalty will be followed by the compensation. If it is appropriated and there is a balance, it will be refunded when the fee is paid according to the provisions of Article 12.

4. If the application fee set forth in paragraph 2 is not paid by the date specified by the hotel pursuant to the provisions of the same paragraph, the accommodation contract shall cease to be effective. However, this is limited to cases where the hotel has notified the guest of her fact when specifying the due date for payment of the application fee.

Article 4 Special contract that does not require payment of application fee

1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may accept a special contract that does not require payment of the application fee set forth in the same paragraph after the contract is concluded.

2. In accepting the application for the accommodation contract, if the hotel does not request payment of the application fee set forth in paragraph 2 of the preceding article or does not specify the due date for payment of the application fee, the special provision set forth in the preceding paragraph shall be met. Article 5 Refusal to conclude an accommodation contract

1. The hotel may not accept the conclusion of an accommodation contract in the following cases.
(1) When the application for accommodation does not comply with this agreement.
(2) When there is no room in the guest room due to full occupancy (members).
(3) When it is recognized that the person who intends to stay may act in violation of the provisions of laws and regulations, public order, or good manners and customs regarding accommodation.
(4) When the person who intends to stay is deemed to fall under any of the following (a) to (c).

The gangsters (hereinafter referred to as "gangsters") stipulated in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Boryokudan Members (Act No. 77 of 1991), stipulated in Article 2, Item 6 of the same Article. Article 6 Guest contract cancellation right

1. The guest can cancel the accommodation contract by notifying the hotel.
2. The hotel cancels all or part of the accommodation contract due to reasons attributable to the guest.
(Except when the hotel requests payment by designating the payment date of the application fee pursuant to the provisions of Article 3, Paragraph 2 and the guest cancels the accommodation contract before the payment) Will charge a penalty in accordance with the provisions listed in Attached Table 2. However, if the Hotel complies with the special provisions set forth in Article 4, Paragraph 1, the Hotel will inform the guest of the obligation to pay the penalty when the guest cancels the accommodation contract in order to comply with the special provisions. Article 7 Right to cancel the contract of our hotel

1. The hotel may cancel the accommodation contract in the following cases.

Article 8 Accommodation registration

Article 9 Guest room usage time

1. Guests can use our guest rooms from 3:00 pm to 11:00 am the next day. However, if you stay consecutively, you can use it all day except the arrival date and departure date.
2. Notwithstanding the provisions of the preceding paragraph, the hotel may accept flights for guest rooms outside the hours specified in the same paragraph. In this case, the following additional charges will be charged. 3,000 yen per room per hour (excluding consumption tax). However, less than 1 hour will be rounded up to 1 hour.

Article 10 Compliance with usage rules

1. The guest shall follow the usage rules established by the hotel and posted in the hotel within the hotel.

Article 11 Business hours

1. The business hours of the main facilities of the hotel will be announced on the website, pamphlets provided, notices in various places, and in-room information.

Article 12 Payment of fees

1. The breakdown of accommodation charges, etc. payable by the guest is as listed in Attached Table 1.
2. Payment of the accommodation charges, etc. in the preceding paragraph shall be made at the front desk when requested by the hotel by Japanese Yen, accommodation vouchers, credit cards, etc.
3. Even if the guest does not voluntarily stay after the hotel has provided the guest room and made it available for use, the accommodation fee will be charged.

Article 13 Responsibility of the hotel

1. The Hotel will indemnify the guest for any damages caused to the guest in the performance of the accommodation contract and related contracts, or due to the non-performance thereof. However, this is not the case if he does not attribute it to the hotel's blame.

Article 14 Handling when contracted guest rooms cannot be provided

1. If the hotel cannot provide the guest with the contracted guest room, the hotel shall, with the consent of the guest, arrange other accommodations under the same conditions as much as possible.
2. If the hotel cannot arrange other accommodation facilities regardless of the provisions of the preceding paragraph, the hotel will pay the guest a compensation fee equivalent to the penalty, and the compensation fee will be applied to the damage compensation amount. However, we will not pay compensation if there is no reason to blame the hotel for not being able to provide the guest room.

Article 15 Handling of deposits, etc.

1. If any damage such as loss or damage occurs to the goods, cash, securities and other expensive goods (including valuables) left by the guest at the front desk, it may be force majeure. However, for cash, securities and other expensive items (including valuables), when the hotel requests a declaration of the type and price, and the guest does not do so and deposits it. Article 16 Storage of guest's baggage or personal belongings

1. If the guest's baggage arrives at the hotel prior to the stay, it will be responsibly stored only when the hotel understands it before the arrival, and when the guest checks in at the front desk. I'll give it to you.
2. If baggage or personal belongings are left behind at the hotel after the guest has checked out, the hotel will, in principle, wait for an inquiry from the owner and ask for instructions. Unless instructed by the owner, valuables will be delivered to the nearest police station within 7 days, including the date of discovery, and other items will be disposed of after 3 months. However, food and drink, cigarettes, etc. will be disposed of on the same day.
3. The responsibility of the Hotel for the storage of guest's baggage or belongings in the case of the preceding two paragraphs shall be in accordance with the rules of paragraph 1 of the preceding article in the case of paragraph 1 and the preceding article in the case of the preceding paragraph. Article 17 Responsibility for parking

Article 19 Disclaimer

1. The Hotel will not be liable for any damages incurred by the Guest due to the intention or negligence of the Guest.
2. It is the customer's responsibility to use computer communication from within the hotel. The hotel will not be held responsible for any damages caused to the user due to interruption of service due to system failure or other reasons while using computer communication. In addition, when using computer communication, if the hotel deems it inappropriate and causes damage to the Company or a third party, the damage will be compensated.

Article 20 Controlling language

This agreement may be written in languages other than Japanese, but if there is any discrepancy or difference between the agreement and the translated text, the Japanese text shall control in all respects.

Article 21 Revision of accommodation agreement

In order to respond to changes in external factors such as economic conditions and related laws and regulations, or if there is a change in the management and operation status of the Company, the contents of this agreement, including provisions regarding fees and service contents, may be revised.
